Because real estate is also about sharing ownership
A certificate of separation is essential for the division of a property in the land register. The certificate of separation confirms that each unit in a building is structurally separated from other units – for example, by walls, ceilings, and locked entrances, which ensure exclusive use by the respective owner. Assigned rooms such as basements, attics, or parking spaces can also be part of the separate property, provided they are appropriately demarcated. Residential property or partial ownership is therefore considered separate if it is structurally clearly separated from other units.
The separation of separate property is also a legal requirement for the formation of independent residential property. The legal basis for this is § 3 (2) WEG in conjunction with the state building regulations (in Saxony, in particular § 8 SächsBO), which regulates the approval requirement for the division of land. It plays a central role when a building is to be divided into individual ownership units – for example, for the sale of apartments or for restructuring within a community of owners.
The local building authority is responsible for issuing a certificate of separation upon request. This request must be accompanied by plans, floor plans on a scale of 1:100, and a suitable representation of the special and common property.
The certificate of separation thus certifies that each unit can be used independently and can be legally registered in the land register as residential property or partial ownership. At the same time, it forms the basis of the deed of division, which is drawn up by a notary.
